Evidence shortcuts in Hong Kong talent admission 2026: Talent List vs HK$2m
How Hong Kong employers can skip local recruitment proof for GEP and ASMTP in 2026: the Talent List route versus the HK$2 million salary route.
2026-10-17
Under the General Employment Policy (GEP) and the Admission Scheme for Mainland Talents and Professionals (ASMTP), an employer does not have to file proof of difficulty in recruiting locally when the vacancy matches a profession on Hong Kong’s Talent List or pays an annual salary of HK$2 million or above. The Immigration Department’s official FAQ page “Enhancement Measures on Admission Schemes for Talent, Professionals and Entrepreneurs”, as of October 2026, sets out both routes, together with the 28 December 2022 start date and a usual four-week processing time once all required documents are received.
The two routes remove only the local-recruitment-proof step, often described as the market availability test. Every other part of a GEP or ASMTP filing still has to be there.
How can an employer skip proof of local recruitment difficulties?
The employer can rely on two different triggers. The first is the occupation: the post offered falls under the professions with shortage of local supply as listed in the Talent List. The second is pay: the vacancy’s annual salary is HK$2 million or above.
The measures cover both the GEP and the ASMTP. They took effect on 28 December 2022, and they do not change the basic requirement to lodge the standard application and supporting documents.
Route 1: the job is on the Talent List
If the post offered falls under a profession listed in the Talent List, the employer is not required to provide proof to substantiate difficulties in local recruitment. Persons belonging to the professions under the Talent List may apply to work in Hong Kong under the GEP and the ASMTP.
The important filing step is a declaration, not a bundle of recruitment evidence. The Immigration Department FAQ states that an employer has to state and declare in the application form that the post offered falls under the professions as listed in the Talent List in order to be exempted from the market availability test. The Labour and Welfare Bureau draws up job descriptions of the covered professions for employers’ reference.
Route 2: the vacancy pays HK$2 million or more a year
The pay route asks nothing about whether the occupation is scarce. If the vacancy’s annual salary is HK$2 million or above, the employer is not required to provide proof of local recruitment difficulties. The trigger is the offered remuneration, not a shortage list.
What counts toward the HK$2 million threshold?
A high base salary is not the whole test. The Immigration Department FAQ says the annual salary refers to the total remuneration package, including other fringe benefits; it gives housing allowance as an example. So fringe benefits form part of the calculation rather than sitting outside it.
Where can employers check the Talent List professions?
The Immigration Department FAQ directs employers to the Talent List website for details of the Talent List and the professions it covers. The Labour and Welfare Bureau’s job descriptions are named in the same FAQ as a reference for deciding whether a post falls under a covered profession.
Which applications qualify, and what changed on 28 December 2022?
The enhanced measures apply only to GEP and ASMTP applications submitted on or after 28 December 2022. Applications submitted before that date are outside the enhanced measures and follow the previous arrangements; successful applicants then receive the original pattern of limit of stay, described as “2+3+3” years, while eligible top-tier entrants follow a “2+6” pattern under time limitation only.
The same package also relaxed the initial duration of stay on entry for successful GEP and ASMTP applicants from two years to three years on employment condition, or the duration of the employment contract, whichever is shorter. That is a stay arrangement, separate from the recruitment-proof exemption.
How long does a GEP or ASMTP application take?
The Immigration Department says it normally takes four weeks to complete processing of applications submitted under the GEP and the ASMTP upon receipt of all the required documents. The FAQ gives this timeframe for both schemes, measured from receipt of a complete filing.
Because each application turns on its own documents, the summary above reflects the official FAQ as of October 2026 for general reference and is not advice on any individual case; a specific filing should be checked against the Immigration Department’s official page or with a qualified professional.
Is the HK$2 million top-tier income test the same as the salary exemption?
No, they use the same figure in different contexts. The recruitment-proof exemption looks at the vacancy’s annual remuneration package, while the top-tier employment stream looks at the person’s own income history.
The FAQ says that persons admitted under the GEP, the ASMTP, or the Technology Talent Admission Scheme may apply for assessment under the top-tier employment stream if they have taken up employment in Hong Kong for not less than two years and had an assessable income for salaries tax of not less than HK$2 million in the previous year of assessment, even if the expiry of the 3-year limit of stay is not yet approaching. Upon approval, such persons are normally granted an extension of stay on time limitation only without other conditions of stay for a period of five years, counted from the limit of stay originally granted.
Frequently Asked Questions
Do employers still need to prove they advertised locally if the job is on the Talent List?
No separate proof of local recruitment difficulties is required for posts in professions with a shortage of local supply listed on the Talent List. Instead, the employer has to state and declare in the application form that the post falls under the listed professions. The Labour and Welfare Bureau also draws up job descriptions for the covered professions as a reference.
Does the HK$2 million salary exemption use basic salary or total package?
It uses the total remuneration package for the vacancy, including other fringe benefits. The Immigration Department FAQ gives housing allowance as an example of a fringe benefit that counts toward the figure. Basic salary alone is not the test.
When did the recruitment-proof exemption start?
The Immigration Department applies it from 28 December 2022. It covers GEP and ASMTP applications submitted on or after that date, while applications submitted earlier follow the previous arrangements.
How much time should be allowed for a GEP or ASMTP decision?
Processing normally takes four weeks after the Immigration Department receives all required documents. That period is stated for applications under both the GEP and the ASMTP. It assumes a complete filing rather than one missing documents.
Where do I check the current Talent List professions?
The Immigration Department FAQ directs employers to the Talent List website for details of the list and the professions it covers. The Labour and Welfare Bureau’s job descriptions are another reference named in the FAQ.
Is the HK$2 million test for the top-tier employment stream the same as the salary exemption?
No. The exemption looks at the vacancy’s annual remuneration package, while the top-tier test looks at the person’s assessable income for salaries tax of not less than HK$2 million in the previous year of assessment. The top-tier assessment concerns extension applications and, if approved, normally leads to a five-year extension on time limitation only.
