Hong Kong ASSG extension evidence 2026: what Immigration weighs

What Hong Kong's Immigration Department weighs on an ASSG extension in 2026: pay, business performance, economic benefit and length of stay.

2026-10-17

If you entered Hong Kong under the Admission Scheme for the Second Generation of Chinese Hong Kong Permanent Residents (ASSG), your first extension turns on four things: your remuneration package, how your business is operating and developing if you have set one up, the economic benefit your work or business brings, and how long you have stayed in Hong Kong. The Immigration Department sets out that list on its FAQ page "Enhancement Measures on Admission Schemes for Talent, Professionals and Entrepreneurs", as of October 2026. The same page also states the condition that catches many applicants off guard: you do not need a job offer to come in, but you need a job or a business to stay.

Who the ASSG covers, and what the first stay allows

An entrant admitted under the ASSG is normally granted an initial stay of 24 months on time limitation only without other conditions of stay. No employment offer is required at the point of initial entry.

The scheme itself is aimed at the second generation of Chinese Hong Kong permanent residents who emigrated overseas. To qualify, an applicant must be aged between 18 and 40, be born overseas (not in the Mainland, the HKSAR, the Macao SAR or Taiwan), and have at least one parent who holds a valid Hong Kong Permanent Identity Card at the time of application and who was a Chinese national settled overseas at the time of the applicant's birth. A good education background is required, normally a first degree; in special circumstances, good technical qualifications, proven professional abilities and/or relevant experience and achievements supported by documentary evidence may be accepted. Applicants must also be proficient in written and spoken Chinese (Putonghua or Cantonese) or English, and have sufficient financial means to cover maintenance and accommodation without recourse to public funds.

What has to be true before you file

You may apply within three months before your limit of stay expires, and the department accepts the application online. Timing matters in both directions: file too early and you fall outside the window; file late and you are overstaying.

Two substantive conditions sit on top of the timing rule.

  • If you are employed, you must have taken up employment at a level commonly taken up by degree holders, and the remuneration package must be at market level.
  • If you have established or joined in a business in the HKSAR, you must produce proof of that business.

If you cannot prove that you will continue to work in Hong Kong, or that you have established or joined in any business, the application may be refused.

Which factors does the department actually weigh?

The published list is not a checklist of documents; it is a set of factors considered together, and the department states it is not limited to those factors.

Factor What the published rule says How it applies to your file
Remuneration package Weighed for employed applicants Your pay has to sit at market level, and the post has to be one a degree holder would normally take
Operation and development of the business Weighed for applicants who have established or joined a business Business proof, and how the business is running and developing, drives both approval and length
Economic benefits Benefits brought by the employment or business The contribution of your work or business, not just its existence
Duration of stay in the HKSAR Listed as a factor The page does not define how it is weighted, so treat it as one input rather than a threshold

Remuneration package

For an employed applicant, the two linked tests are the level of the post and the level of the pay. A job below the level commonly taken up by degree holders, or a package below market level, goes to the heart of the assessment rather than to a peripheral detail.

Operation and development of the business

Applicants who have established or joined in business are required to produce proof of their business, and the same business evidence feeds the length of stay decision: for those applicants, the extension period is determined based on a comprehensive consideration of the operating conditions of the relevant business.

Economic benefits brought by your employment or business

This is an outcome-facing factor. The published wording asks what benefit the employment or business brings, which is different from asking whether you are busy or whether the entity exists.

Duration of stay in the HKSAR

Length of stay is listed among the factors, but the page does not explain how it is measured or weighted. The honest reading is that it is one input in a combined assessment, not a target you can hit on its own.

How long can the extension be?

Successful applicants are normally granted an extension of stay on time limitation only without other conditions of stay for not more than three years, or until the expiry of their employment contract in the HKSAR, whichever is shorter.

So the contract end date can cut the grant short. If your employment contract expires in eighteen months, the ceiling of three years does not help you; the shorter of the two applies.

For applicants who have established or joined in a business, no fixed pattern is published. The length granted is decided on the operating conditions of the business.

Is there a six-year option?

Yes, through assessment under the top-tier employment stream. Persons admitted under the ASSG who have been permitted to remain in the HKSAR under the scheme for not less than two years, and who have an assessable income for salaries tax of not less than HK$2 million in the previous year of assessment, may apply for that assessment at the time of the extension application. Successful applicants are normally granted an extension on time limitation only without other conditions of stay for a period of six years.

Note what this does and does not do: it changes the length and conditions attached to the grant. It does not remove the underlying expectation that you are working in Hong Kong at a level consistent with the scheme.

How to build the file before you apply

The FAQ does not publish a fixed document list for ASSG extensions, so build the file around the factors the department says it weighs. The requirements published by the Immigration Department govern; this article provides general information only and is not advice on any individual case.

Read the expiry date printed on your limit of stay. Count back three months from that date to find your filing window. Decide which track you are on: employed or business. Collect material that shows the level of your post and the level of your pay. If you run a business, collect proof of the business and evidence of how it is operating and developing. Add anything that shows the economic benefit of your work or business. Submit the application online within the window.

Suppose an applicant has been offered a role titled "operations assistant" with pay below what comparable graduate roles command. The published tests are the level commonly taken up by degree holders and market-level pay, and that scenario fails both on its face, regardless of how much the applicant wants to stay.

Where decisions go against applicants

Refusal risk clusters in one place: the inability to prove continuing employment or a business. The published wording is explicit that an application may be refused if the applicant fails to prove that he or she will continue to work in the HKSAR or has established or joined in any business. Employment below degree-holder level, or a pay package below market level, points the same way, because both sit inside the factors the department weighs rather than outside them.

Frequently Asked Questions

Do I need a job offer to enter Hong Kong under the ASSG?

No. An applicant is not required to have secured an offer of employment in Hong Kong upon application, and an entrant is not required to secure an employment offer upon initial entry. The employment expectation applies at the extension stage, not at entry.

How early can I apply for an extension of stay?

You may apply within three months before the expiry of your limit of stay. The application can be submitted online.

How long is the extension normally granted for?

Successful applicants are normally granted an extension on time limitation only without other conditions of stay for not more than three years, or until the expiry of their employment contract in the HKSAR, whichever is shorter. For business applicants, the length is decided on the operating conditions of the business.

Can I get six years instead of three?

Yes, if you qualify for assessment under the top-tier employment stream. You need to have remained in the HKSAR under the scheme for not less than two years and to have an assessable income for salaries tax of not less than HK$2 million in the previous year of assessment. Successful applicants are normally granted six years on time limitation only.

What evidence does a business founder need?

Applicants who have established or joined in business in the HKSAR are required to produce proof of their business. The same business evidence also feeds the decision on how long the extension runs, since that is based on the operating conditions of the business.

Is the list of assessment factors exhaustive?

No. The Immigration Department states that the factors considered include but are not limited to the remuneration package or the operation and development of the business, the economic benefits brought, and the duration of stay in the HKSAR.

Can I bring dependants while on the ASSG?

Yes. An entrant may apply to bring in a spouse or the other party to a same-sex civil partnership, same-sex civil union, "same-sex marriage", opposite-sex civil partnership or opposite-sex civil union entered into outside Hong Kong in accordance with the local law in force of the place of celebration and with such status being legally and officially recognised by the local authorities of the place of celebration, and unmarried dependent children under 18, under the prevailing dependant policy. The entrant acts as the sponsor.
