Employment and Establishment Evidence for NIV 858 in 2026: Income Outside Your Field Doesn't Count
Why Subclass 858 establishment evidence excludes income earned outside your area of achievement, and what the official document list accepts instead.
2026-10-06
No — income from work outside your area of achievement cannot be used to show that you can establish yourself in Australia. The Australian Department of Home Affairs states this as a flat exclusion on its National Innovation visa (Subclass 858) official page, in the "Ability to establish yourself in Australia" section: "You cannot include income from work outside your field." That is the position on the official page as of August 2026. This article describes how the published criteria and document lists read; it is general information rather than personalised advice, so your own case should be measured against the current official wording and, where it matters, against advice from someone authorised to give it.
What does Subclass 858 ask you to prove about establishing yourself?
The eligibility criterion is short: you must demonstrate that you would be able to find work, or become independently established, in your area of expertise in Australia without difficulty. Two things carry weight in that sentence. The first is "without difficulty" — the test is about ease of entry into Australian working life, not about whether you could survive financially somehow. The second is "in your area of expertise" — the same area in which you claim your internationally recognised record of exceptional and outstanding achievement.
That link matters more than it first appears. The department's step-by-step page states that documents in the visa application must show the achievements claimed in your Expression of Interest, because those achievements are what produced your invitation to apply. The Migration Regulations 1994, in the consolidation published on the Federal Register of Legislation, go further at clause 858.212(3): the area of achievement and the achievements claimed in the application must be the area and achievements stated in the invitation. Your establishment evidence therefore sits at the end of a chain that runs from the EOI to the invitation to the Form 1000 nomination to the application. Income from an unrelated field has no place in that chain.
Why does outside income fail the test?
Because the criterion is about capability in a field, not about resources. Money you earn from work that has nothing to do with your area of expertise tells a decision maker nothing about whether Australian employers, institutions, funders or markets will take up your particular record. It answers a question the visa does not ask.
The same boundary appears in the department's procedural guidance for this visa: existing funds on their own do not satisfy the establishment requirement, because the applicant must show an ability to keep supporting themselves through their skills. Procedural guidance is not legislation, and its current form should be confirmed against the department's latest published policy before you rely on it.
Suppose an applicant is an internationally recognised materials scientist whose Australian income plan rests on rental returns from a property portfolio and dividends from a family logistics business. Neither demonstrates that Australian research institutions or companies will engage her. The establishment evidence has to come from the science.
What evidence does the official page actually list?
The official page asks you to "prove you can work or support yourself in your area of achievement" and lists five things you should give:
| Evidence listed | What it is meant to show | Field requirement |
|---|---|---|
| A statement detailing your knowledge of opportunities in Australia in your area of achievement | That you understand where the demand for your work actually sits | Must be about your area of achievement |
| Information provided by your nominator | Independent, nationally-reputed confirmation of your standing and prospects | Nominator must have a national reputation in the same area |
| Letters from Australian organisations or other relevant bodies showing future employment or possible business opportunities | Concrete Australian uptake, not just intent | Must relate to your field |
| Qualifications or experience gained during previous residence in Australia | That you have already operated in the Australian setting | Relevant to the claimed area |
| Your employment or business background | A track record of sustaining yourself through that work | Background in the field carries the weight |
The exclusion sits underneath all five: whatever you submit, income from work outside your field is not part of it.
Where does the "knowledge of opportunities" statement fit?
It is the one item on the list that every applicant can produce regardless of whether an Australian job offer exists, and it is the item most often written badly. A useful statement is specific about the Australian ecosystem for your work — the institutions, funders, companies, competitions, sectors or research programmes relevant to your field — and then connects your own record to that demand. A statement that only praises Australia's lifestyle or economy shows no field-specific knowledge and adds nothing to the establishment question.
It also has to agree with the rest of the file. If your statement describes opportunities in quantum computing while your invitation, Form 1000 and achievement evidence are in contemporary sculpture, the inconsistency is the problem, not the writing.
Does the Fair Work High Income Threshold appear here too?
It appears on the other side of the same line. Among the examples of evidence for your record of achievement, the official page lists "current earnings or an offer of employment with earnings at or above the Fair Work High Income Threshold, in your area of achievement." The qualifier is doing the work: high earnings count as evidence of standing only when they come from the area in which you claim your record. The same page's establishment section then excludes income from work outside your field. The threshold figure itself is set by the Fair Work Commission and changes over time, so the current amount should be taken from that source rather than assumed.
How do applicants usually get this boundary wrong?
For example, suppose an applicant is a professional athlete whose plan relies on income from a fitness apparel business he owns. The business is commercial success, but it is not his sport, and it does not show that he can work or be independently established as an athlete in Australia. Suppose instead an applicant is a prize-winning novelist who intends to live on contract software work after moving. The software income is not in her area of achievement and cannot carry the establishment claim. Or suppose an applicant submits a decade of consulting earnings in a discipline adjacent to, but different from, the one named in the invitation — the closer the adjacency, the more important it becomes that the claimed area, the nomination and the establishment evidence all point the same way.
The consistent failure mode is the same in each case: strong financial evidence attached to the wrong field.
What if I have no Australian job offer?
A job offer is not the only route. The listed evidence is deliberately broader than employment: letters from Australian organisations or relevant bodies about possible business opportunities, your employment or business background, and qualifications or experience from previous residence in Australia can all speak to the question. What they must share is direction — towards working or being independently established in the area in which you were invited.
Frequently Asked Questions
Can I use income from outside my field to prove I can establish myself in Australia?
No. The official Subclass 858 page states directly that you cannot include income from work outside your field. The exclusion applies to the establishment requirement specifically, and it does not depend on how much the income is or how stable it looks.
Do I need a job offer from an Australian employer?
No, but you need to show that you can find work or become independently established in your area of expertise without difficulty. Letters from Australian organisations or other relevant bodies showing future employment or possible business opportunities are one of the evidence types the official page lists.
Is the statement about knowledge of opportunities in Australia compulsory?
It is one of the items the official page says you should give for the establishment requirement. Because it is available to every applicant regardless of employment status, it is the piece most worth getting right rather than treating as a formality.
Does the same field limit apply to my achievement evidence?
Yes. Where the official page lists current earnings or an employment offer at or above the Fair Work High Income Threshold as achievement evidence, it specifies that the earnings must be in your area of achievement. Earnings from unrelated work do not substitute.
What if my Australian plans involve work that is related to but not identical to my claimed field?
The safest position is alignment: the area and achievements in your application should be the ones stated in your invitation, per clause 858.212(3) of the Migration Regulations 1994. Where your plans sit at the edge of your claimed area, the risk is inconsistency between the invitation, the Form 1000 nomination and the establishment evidence, and the current official wording should be checked before you lodge.
Does a completed Form 1000 affect this part of the assessment?
It is required in a different way. A completed Nomination for National Innovation visa (Form 1000) must be attached when you apply, and the department states it will not process the application without it. Your nominator must have a national reputation in the same area as you, which is another reason field consistency runs through the whole file.
