What the Critical Skills Employment Permit is

Because the Critical Skills Occupations List defines which roles qualify, the first practical step is to check whether your occupation appears on that list. The official guidance does not reproduce the list itself, so you must verify your occupation against the official Critical Skills Occupations List published by DETE before you apply.

The application form and where to apply

All first-time applicants for employment permits must make their application while resident outside Ireland. The Irish employment permit system, including the processing of these applications, is operated by the Department of Enterprise, Trade and Employment (DETE).

DETE launched a new online system, Employment Permits Online, on Monday, 28 April 2025, from which time all Change of Employer applications are processed. The official guidance does not state explicitly that first-time Critical Skills applications are also processed through this system, but it does identify DETE as the operator of the employment permit system and points to the DETE Employment Permit Information page for detailed information. You should use the official DETE application route rather than any third-party form.

There is no separate “Critical Skills” form in the official guidance. The application is made through the employment permit application process, and the permit type is selected within that process. If you are a visa-required national, you must obtain the employment permit before you apply for a visa to travel to Ireland.

Evidence required for the application

The official guidance does not provide a full checklist of documents for the initial Critical Skills application. It does, however, specify evidence requirements for the related change of employer process, and it states generally that visa applications require supporting documents. For the change of employer application, the following documents must be submitted:

  • a copy of the new Contract of Employment, signed by both the employer and the employee
  • a statement issued by the Revenue Commissioners showing the monthly statutory returns made by the employer, dated within the 3-month period preceding the application

If the new employer is operating a restaurant business, additional information is required:

  • a letter from the relevant Local Health Authority confirming that the employer has been granted permission to operate a restaurant at the premises
  • a statement from the employer that the employee will be employed in an establishment other than a fast-food outlet
  • copies of utility bills for the establishment’s premises, dated within a 2-month period prior to the application

For the initial application, the official guidance does not list equivalent documents. You should check the DETE application requirements for the specific permit type and your circumstances. The Irish Immigration Service also states that you will have to submit documents in support of a visa application, and that supporting document requirements are set out for all categories of long stay employment visa applications.

How the permit interacts with a visa

If you are a visa-required national, you must apply for a visa before travelling to Ireland. You can apply for all employment visa types up to 3 months before your date of travel. You should apply for a visa as soon as possible after the granting of an employment permit, hosting agreement, or immigration permission.

You must have obtained an employment permit from DETE or a letter of immigration permission before applying for an employment visa. If you have not been granted an employment permit and are not exempt from the requirement to hold one, your visa application will be refused.

When completing the online visa application form, you should select the visa/preclearance type as ‘Long Stay (D)/Short Stay (C)’, the journey type as ‘single’ or ‘multiple’, and the reason for travel as ‘Employment’ if you intend to work for more than 90 days on the basis of having obtained an employment permit from DETE. You must make your visa application from the country where you are ordinarily resident. Requests to make a visa application from any other country will not be accepted.

Changing employer while holding a Critical Skills permit

The 2024 Act introduced a provision allowing certain employment permit holders to change their permit employer to another employer after a period of nine months has passed since commencing their first employment permit in the State. This provision applies to both the General Employment Permit (GEP) and the Critical Skills Employment Permit (CSEP).

The change of employer provision eliminates the need to apply for a new permit, but it is restricted to movement within the occupation or occupation classification on the original permit. The holder of a CSEP can change to an employer across a broader category of employments, for example different engineering roles, identified by its 3-digit SOC code. This additional flexibility for CSEP holders is due to the fact that their roles are identified on the Critical Skills Occupations List, indicating high demand for these skills in the labour market.

The following conditions apply:

  • the permit must be in force and will remain in force for at least two months when making the application
  • the maximum number of applications for change of employer that may be granted to a permit holder has been set at three
  • the employee is required to commence employment with the new employer within one month of the new permit being issued
  • the new employment cannot be commenced until the employment permit has been reissued

Unlike applications for new permits, there is no requirement to conduct a labour market needs test before the permit holder applies to change their employer. The permit holder will be allowed to change employer provided that they are transferring to an occupation similar to the occupation for which they have been permitted to enter the State.

If the employment you wish to move to is outside the scope of the change of employer process, a new employment permit application will need to be submitted. For a Critical Skills Employment Permit, the new role must be within the same category of employment (that is, the 3-digit Standard Occupational Classification Code) for which the employment permit was first granted. All employment permits are valid only for the employer and the employment stated on the permit.

If you are currently working in Ireland on your first employment permit, you are expected to continue in that employment for a period of nine months from the commencement of the employment. In exceptional circumstances, such as redundancy, or where circumstances arise that fundamentally change the employment relationship, you may be granted an employment permit for an alternative, eligible job within the first nine months.

Practical steps and what to verify

The change of employer application is a joint application, with each party completing their respective parts. The employee provides their personal information, and the employer completes the fields relevant to them and uploads any required documentation. The application must be signed by all parties involved. The same joint-application principle is likely to apply to the initial permit application, since the employer must be a party to the employment relationship, but the official guidance does not state this explicitly for first-time applications.
